On 22 April 2024 the Belgian DPA’s Litigation Chamber issued a prima facie warning to an anonymised service provider in decision 60/2024, DOS-2023-04811. The provider repeatedly initiated social-tariff eligibility checks using the wrong customer’s number; the customer received refusal notices despite not requesting the checks. The company described the acts as database consultations, while the Chamber assessed the erroneous processing and possible inadequate safeguards under GDPR Articles 5(1)(f), 24 and 32. The adopted operative box on page 5 issues a warning under Article 58(2)(a), not a monetary sanction or a final merits finding. The provider could request merits reconsideration or appeal. Neither absence of consent alone nor the notification dates are substituted for the actual decision date.
Outcome
Warning
A formal warning issued by a DPA without a monetary penalty.
